1. Scope of Services
Clear Apply Melbourne ("Clear Apply", "we", "us") provides rental application preparation and administrative support services to tenants in the Melbourne rental market.
Our services include:
- • Review, preparation, and formatting of rental application documents
- • Tailored cover letter writing
- • Document quality checks and feedback
- • Guidance on application completeness
- • Optional authorised submission of applications on digital platforms (with client consent)
Our services DO NOT include:
- • Acting as your agent, representative, or advocate
- • Communication with property managers, landlords, or real estate agents on your behalf
- • Guarantees or assurances regarding rental outcomes
- • Legal, financial, or tenancy advice
- • Ongoing representation beyond the services purchased
2. No Guarantee of Outcome
Clear Apply provides administrative and preparation support only. We do not guarantee, promise, or imply that:
- • Your application will be accepted
- • You will secure a lease
- • You will be shortlisted or invited to inspect
- • Any particular outcome will result from using our services
Rental outcomes depend on many factors outside our control, including but not limited to:
- • Landlord and property manager preferences
- • Competition from other applicants
- • Property-specific criteria and requirements
- • Market conditions
3. No Agency / No Representation / No Advocacy
Clear Apply does not act as your agent, legal representative, advocate, or intermediary.
This means:
- • We do not contact property managers, landlords, or agents on your behalf
- • We do not negotiate terms, request updates, or follow up on your applications
- • We do not speak for you or make representations about you to third parties
- • Our role is strictly limited to document preparation and administrative support
You remain solely responsible for:
- • Submitting applications (unless you have authorised us to do so)
- • All communication with property managers and landlords
- • Following up on application status
- • Attending inspections and interviews
- • Negotiating lease terms
4. Client Responsibilities & Accuracy of Information
By using Clear Apply's services, you acknowledge and agree that:
You are responsible for:
- • Providing accurate, complete, and truthful information
- • Supplying all required documents in a timely manner
- • Reviewing and approving all materials prepared by Clear Apply before submission
- • Ensuring all statements made in your application are truthful and not misleading
- • Updating us immediately if any information changes
You declare that:
- • All information and documents you provide are genuine and accurate
- • You have the legal right to provide and use all documents supplied
- • You understand that false or misleading information may result in application rejection or legal consequences
- • You will not hold Clear Apply liable for any outcomes resulting from inaccurate or incomplete information you have provided
5. Authorised Submission Support
If you purchase Authorised Submission Support, you grant Clear Apply permission to:
- • Access rental application platforms (1Form, 2Apply, Snug/Ignite, or similar) using credentials you provide
- • Complete application forms using information and documents you have supplied
- • Submit applications on your behalf
Conditions of authorised submission:
- • You must provide written authorisation (email confirmation accepted)
- • You must review and approve all information before we submit
- • You must provide platform access credentials securely
- • You remain fully responsible for all information submitted
- • We will handle your credentials securely and delete them within 30 days of service completion
- • This is an administrative service only—no advice, advocacy, or representation is provided
6. Definition of an "Application"
For the purposes of our services and bundles, one (1) "application" means:
- • Preparation or review of documents for one (1) specific rental property
- • Tailoring of cover letter to address that property's requirements
- • Quality check and platform readiness for that property
- • Optional authorised submission for that property (if this add-on has been purchased)
If you apply for multiple properties, each property counts as one application, even if documents are similar.
7. Application Bundle Top-Ups
What's included:
- • Top-Up Bundles provide additional application preparations beyond your initial package
- • Each application in the bundle includes document review/update, cover letter adjustment, quality check, and platform readiness
- • Optional authorised submission is available if you have purchased that add-on
Terms:
- • Bundles must be used within 90 days of purchase date
- • Bundles are non-transferable (cannot be gifted, sold, or transferred to another person)
- • Bundles are non-refundable once purchased
- • Unused applications in a bundle expire after 90 days and cannot be extended or refunded
- • Applications cannot be "banked" or held indefinitely
8. Active Application Support Window
What's included:
- • 14 consecutive calendar days of active support from the date you activate the window
- • Up to 2 application reviews or updates during the 14-day period
- • Priority email response times (within 24 hours during business hours)
- • General guidance and platform assistance
- • Support provided Monday-Friday, 9am-6pm AEDT (business hours only)
Limits and exclusions:
- • Maximum of 2 application updates during the window (additional applications require Top-Up Bundles)
- • Does not include full new application preparation (only updates/reviews)
- • Support provided via email only (no phone or in-person meetings unless separately arranged)
- • Window begins when you activate it (not automatically from purchase date)
- • Once activated, the 14-day window cannot be paused, extended, or refunded
Renewal:
- • Support windows are not automatically renewed
- • If you wish to purchase another window, you must opt-in and pay separately
- • Multiple windows cannot run concurrently
9. Turnaround Times
Standard turnaround:
- • Application Health Check: 2 business days from receipt of all required information
- • Full Application Preparation: 3 business days from receipt of all required information
Priority turnaround:
- • Included in Priority Application Support package
- • 1-2 business days per application from receipt of all required information
Business days defined:
- • Monday to Friday, excluding public holidays in Victoria, Australia
Important notes:
- • Turnaround times begin when we have received ALL required information and documents from you
- • Delays in providing information will extend turnaround times accordingly
- • Turnaround times are estimates, not guarantees
- • During peak periods, times may be longer—we will notify you if delays are expected
10. Refunds & Cancellations
Refunds available:
- • Full refund if we have not commenced work on your service
- • Full refund if we fail to deliver the service as described
Refunds NOT available:
- • Once substantial work has been completed (e.g., review conducted, documents prepared, feedback provided)
- • For services already delivered, even if you choose not to use them
- • For Application Top-Up Bundles or Active Support Windows once purchased (as these are optional add-ons purchased with full knowledge of terms)
- • For rental application outcomes or rejection (as we do not guarantee outcomes)
Cancellation process:
- • To request a cancellation or refund, email us at hello@clearapply.com.au
- • Refund requests will be assessed within 3 business days
- • Approved refunds will be processed within 7 business days
Fair use:
- • We reserve the right to refuse service or refund in cases of abusive behavior, fraudulent activity, or misuse of services
11. Privacy & Data Handling
How we handle your information:
- • All documents and personal information are stored securely using encrypted systems
- • Your information is used solely for the purpose of providing our services
- • We do not share your information with third parties except as required to deliver services (e.g., submitting to rental platforms with your authorisation)
- • We comply with Australian privacy principles
Data retention:
- • We retain your documents and information for 30 days after service completion to allow for follow-up requests
- • After 30 days, all files are securely deleted unless you request longer retention for your records
- • If you wish to have your data deleted sooner, contact us and we will comply within 7 days
Your rights:
- • You have the right to access, correct, or request deletion of your personal information at any time
- • Contact us at hello@clearapply.com.au for data requests
12. Limitation of Liability
To the fullest extent permitted by law:
Clear Apply's liability is limited to:
- • The amount you paid for the specific service in question
- • Refund or re-performance of services not delivered as described
Clear Apply is not liable for:
- • Rental application outcomes, rejections, or decisions made by landlords or property managers
- • Losses, damages, or consequences arising from information you provided
- • Technical issues with third-party platforms (1Form, 2Apply, Snug/Ignite, etc.)
- • Delays caused by your late provision of information or documents
- • Any indirect, consequential, or incidental damages
Your acknowledgment:
- • You acknowledge that rental outcomes are outside our control
- • You accept full responsibility for the accuracy of information you provide
- • You understand that we provide administrative support, not guarantees
